EDUCAÇÃO DOMICILIAR: análise constitucional e jurisprudência do STF

Abstract

The present work deals with homeschooling, in view of the controversies originated by the lack of regulation on this legal asset and by the fact that there are strong arguments both favorable and unfavorable to the practice. The aim is to briefly analyze education in its home form under the historical and social bias, presented in the first topic, under the jurisprudential perspective, contained in the second topic and in legal terms, in the third topic. This intent will be provided through research in articles, laws, jurisprudence and books. The current study allowed us to observe the contrast of legal arguments and interpretations dealing with the subject, as well as demonstrated that the matter is not a simple solution, a fact exemplified even in the Extraordinary Appeal (RE) that will be exposed, in which it refers to the non-unanimous positions of the court.
