MULTIPARENTALIDADE: Seus efeitos no direito das sucessões quando houver concorrência sucessória entre cônjuges e ascendentes

Abstract

This paper analyzes the institute of multiparenting and the application of inheritance law when there is inheritance competition between spouses and ancestors. Such an approach is due to the fact of the great evolution that the family institute has been undergoing.The family has a great value within society and its evolution has been generating reflexes in the legal world and within the family and inheritance legislation. The aim of this study is to analyze the multiparenting institute, currently present in the daily lives of Brazilian families, as well as its consequences within Succession Law, considering that this institute directly influences it. Multiparenting within Brazilian homes has become commonplace that deserves the legislator's attention. Thus, it is necessary to verify the possibilities of applying the Succession Law in cases where multiparenting is recognized, ensuring that the rights of all parties are ensured. This purpose will be achieved by researching doctrines, case law and articles. The study clarified that the reflexes of multiparenting within family law and successions are enormous and the great effort of the legislature and judiciary is still needed to standardize the reflexes and solutions of the problems within the institute.
