| Resumo: | O presente artigo tem por objetivo analisar a repercussão que o ativismo judicial tem provocado diante da crescente judicialização dos interesses sociais frente a mora legislativa sob a justificativa de efetivação dos direitos fundamentais e a garantia do mínimo existencial, exatamente no que tange a inefetividade do Estado para a promoção de políticas públicas, as quais são indispensáveis para resguardar a tutela dos interesses da humanidade, principalmente quanto às parcelas mais fragilizadas da coletividade. Nesse sentido, tem-se como intuito analisar os principais pontos do debate sobre a temática, como por exemplo: o conflito gerado frente às decisões judiciais que, tanto direta ou indiretamente provocam grandes impactos financeiro ao erário sob a égide da garantia aos direitos fundamentais constitucionais, em razão da essencialidade destes para os indivíduos, aos seres humanos; a crise econômica do Estado juntamente com a carência orçamentária, e a reserva do possível. |
| Abstract: | This article aims to analyze the repercussion that judicial activism has had on the judicialization of politics in relation to the justification for the realization of fundamental rights and the guarantee of the existential minimum, precisely with regard to the State's ineffectiveness in promoting public policies, which are indispensable to safeguard the protection of the interests of humanity, especially regarding the most fragile of the collectivity. It is intended to debate the themes that are most consistent with the present day, such as: the conflict generated in the face of court decisions that, either directly or indirectly, cause great financial impacts to the treasury under the aegis of guaranteeing fundamental constitutional rights, which are essential to human beings, the economic crisis of the State together with the lack of budget, and the reserve of the possible. |
