| metadata.dc.description.resumo: | O trabalho exposto se desenvolve em volta do Processo Penal Cautelar, evidenciando o valor da existência real do mesmo para tornar as decisões úteis, relacionando as particularidades e os pressupostos encontrados na doutrina analisada, focando a prisão preventiva em seu caráter jurídico, seus pressupostos, as hipóteses previstas em lei que permitem tal medida, o momento de sua sentencia, quem pode solicitar a custódia cautelar e quem é a autoridade capacitada para decretá-la, as defesas legais da imposição da medida, ponderando tal instituto processual penal em face do princípio da presunção de inocência, disposto expressamente na Constituição Federal de 1988. |
