Abstract

This research project proposes to analyze the social security changes brought about by Constitutional Amendment 103/2019 regarding retirement by contribution time and its effects on social security, comparing recent norms in relation to past years, as well as observing the impacts of relationships parallel to the aforementioned retirement right.

The reform brings, mainly, stricter criteria for access to retirement and changes in the calculation rules, both in the regime that mainly serves private sector workers (Regime Geral de Previdência Social – RGPS) and in the regime for public servants of the Union (Regime Geral de Previdência Social - RGPS). Retirement based on contribution time, also known as retirement based on length of service, since its creation, is one of the most common of the INSS and was one of the most affected rules with the Pension Reform of 2019, so much so that nowadays it does not exist. most. There is only the possibility of retiring for it in the transition rules, or proving the right acquired before the modification occurred.The objective of this work is to elucidate why there was a need to create a pension benefit for retirement by contribution time, what were the aspects used to extinguish one of the most common modalities of the INSS and the existing hypotheses of obtaining the benefit in the rules subsequent to the remodeling. This purpose will be achieved through current legislation and through bibliography on the subject.
